Whether in the common law or civil law, most countries have a system of police serving as a witness at court.Even if it is restricted, it will not be limited like ours.It is obviously contrary to the mainstream world. Although I have to consider our country conditions,the value of the common pursuit of mankind is consistent. Such as fair and justice in any country are indispensable. Improve the system of our country has very important significance, but the lack of the system will lead to many problems in practice. In reality, there are many places began to try to reform, there are some typical cases to system of police serving as a witness. In July 1,2010, Supreme People's Court, Supreme People's Procuratorate,the Ministry of Justice,Ministry of Public Security, Ministry of State Security issued a"the exclusionary rule in criminal cases ". This provision provides a very clear situation of system of police serving as a witness.It will be gradually recognized from the legislative and judicial activities can be seen.The author first start discussion from the general principle system of police serving as a witness,then analyze our current the problems and obstacles of system of police serving as awitness. On the basis of examination and Comparison of Modern Western legislative and judicial situation,I make my advice. In the proposal, first,I demonstrate the identity of the investigator,the identity of the witness and is to appear as a witness for the court. In the clear this premise, I described common situations.To safeguard the smooth implementation of this system proceedings in court to be discussed. Of course, like other systems, the system needs some other measures of protection, it raised a few key safeguards. Hope this article on the future play a role in the legislative and judicial.
