On Chinese Commercial Conciliation

As a characteristic alternative dispute resolution, commercial mediation is able to settle commercial disputes quickly and efficiently. In the world, commercial mediation has been used in many countries for a very long time and is developing rapidly. However, commercial mediation in China is not even well-known, and much less unfamiliar than people's mediation, court mediation or arbitration mediation to the public. Meanwhile, the number of articles focusing on commercial mediation is seriously limited.So, the author tries to make a general introduction about commercial mediation by this thesis, clear up the important questions by discussing commercial mediation's basic content, history, features and principles, and describe the latest situation of China commercial mediation roundly by analyzing new judicial files in China.This thesis'core is pointing out that China commercial mediation urgently needs to be improved and completed, which is necessary because there are huge gaps between the developing level of commercial mediation in China and that in the world, and between what China commercial mediation agreement's legal effect will be and that actually is. At last, some pointed advices will be given.
