Banks are crucial to a country's financial system, especially in China, which depend the indirect finance. As the public company, bank crisis exert great influence on the economical and financial order and social stability. In order to save the commercial bank in trouble, receivership comes out. The thesis commences the common theory and then analyzes the conditions and inner mechanism of receivership to provide some approaches to build the system of Chinese receivership.In the Chapter One, this thesis describes certain basic theories. Receivership is an approach coping with the banks in trouble to help them avoid bankruptcy. It is initiated by the regulator authority. As it usually involved in the administrative procedure, it differs the reorganization and bankruptcy which is lead by the court. With many cases happened in the financial crises, receivership of the commercial bank is increasingly noticed by the world.Chapter Two introduces the condition and the standard of the receivership. The thesis mainly compares the standard of assets, liquidity, supervision and other condition all around the world. The standard of CAMELS, mainly used by the international, can be took advantage of by China. Then, the thesis illustrated the standard of receivership in China and analyzes the history of the evolution of receivership.Chapter Three mainly discusses receiver. Receiver plays the core role in the process of receivership. With the definition of the receiver's status, we make further understanding of the rights and the obligation of receiver. In the end of this chapter, the thesis also provides information of the appointment and the termination of receiver.Chapter four presents the specific measures of receivership. These measures are so crucial that they are related to the destiny of the banks. The common methods include special aids, bank reorganization, assets exchange and the reload implemented by the central bank.Chapter five is the chapter that puts forward the solution to the Chinese receivership.
