China's System Of Small Claims Procedures To Build

As an important legal system, small claims procedure has got more and more attention around the world. Many countries have set up small claims systems. With the development of our society, the system is badly needed. This article intends to make an analysis of this.This text is divided into five chapters:ChapterⅠ:The concepts, characteristics, theoretical basis and value orientation of small claims procedure. From the global trend of judicial reform and the need of judicial practice in China, I clarify the value and significance of introducing small claims procedure to China.ChapterⅡ:From the empirical study of the overseas system, I compare the similarity and difference of two legal legislations. From the study on the development trend of the overseas system and the direction of evolution, I discuss what it can bring to China.ChapterⅢ:I analyze the current situation of small claims cases in China and elaborate on the development and problems in China's experiments in small claims court and procedures.ChapterⅣ:Combined with successful experiences from overseas and domestic scholars from multi-views, I put forward my own views on the style, scope, proceedings, judgments, trial-level settings of China's small claims procedure.ChapterⅤ:Focused on the implementation of small claims, small claims and consumer protection, small claims and information technology, I elaborate on how to improve the supporting system. I discuss on how to improve the implementation of case execution, how to make Consumers Association play the role, the introduction of multiple dispute resolution mechanisms, an additional advisory body to intensify propaganda and link community resources, accelerate the pace of the network, set up small claims procedure and matching systems with Chinese characteristics.
