On The Definition Of Public Interest In China's Urban Housing Levy System

Most countries of the world provide the objective of public interest in the expropriation system.And the constitution and legislation also formulate that the nation is able to collect the farmland and the legit private property just for the need of public interest.But the current situation frequently departs from the requirement,and ingracts the rights and benefits of the public.In recent years,the process of city demolition in our country appears missequence,and the issue of expropriation turns into one of the hot spot issues.The expropriation involves individual interests,and the contradictions between individual interests and public interest becomes salient.This paper will analyzes and discuss this issue in detail.This paper is divided into six chapters, introductioan,main contents(four chapters) and conclusion.The introduction raises the issue and thinking of the definition of the public interest.The fist chapter is a comprehensive analysis about public interest.lt will start from the connote of public interest and the discrimination of some analogous conceptions.Then,it will introduce the characteristic of public interest and the necessity of defining the conception of public interest.The second chapter analyzes the current legislation of collection system in our country,and dissects the existing problem in practice.The third chapter illustrates some other countries legal rules about public interest in the collection system, comparing their similarities and differences.Then summarizes some useful experiences for refering.The forth chapter brings forward the corresponding countermeasures which could be used to solve the problems.Briefly conclude the whole paper.
