Study Of Our Lawyers Professional Secrecy

What this article needs to discuss is an evidentiary rules, and is also a lawyer practicing right. Although《Law of the People's Republic of China on Lawyers》which was revised on October 28,2007 expanded the scope of lawyer keeping professional secrets, it has not touched the deep question of protection of lawyers' professional secrets, especially the privilege of evidence exemption has not established in our country that universally exists in developed countries. In the criminal justice domain, the rules of lawyer's professional secrets is a complex question affects effective implementation of lawyer's defensive right, is also one of hot topics in this domain. This paper believes the rules of lawyer's professional secrets involve two aspects, obligation of keeping secrets and privilege of evidence exemption, not to be partial, and not merely confined to areas of criminal proceedings. On the base of reviewing relative legislations abroad, this paper want to explain basic contents, basic theories and value analysis of the rule of lawyer's professional secrets, bring forward the thinking of how to improve our lawyers'professional secrets protecting system by analysis of our laws, rules of laws and criterion of industries.
