Service by publication is an indispensable way of service procedure. However, there are many legislative and judicial problems with our system of service by publication, which need to be resolved. The thesis focuses on reconstruction and direction of the system of service by publication in China by studying laws and regulations of different countries their judicial practice concerning service by publication.Chapter one introduces characteristics and legal effect of service by publication by defining the term. It also analyses the purposes of service by publication in a civil proceeding and further discusses the jurisprudential basis and value of the system of service by publication.Chapter two offers some advice for reconstruction of the system of service by publication through detailed discussion of some typical systems of service by publication in some western countriesChapter three examines the current situation of the system of service by publication. It also analyses the problems with our system of service by publication and their reasons by studying some typical cases, and further offers basis for future reconstruction of our system of service by publication.From the perspective of establishing adversarial system, balancing the interests of different parties, and perfecting the principle of serving information, chapter four suggests some macroscopic and microscopic views for reconstruction of our system of service by publication both based on the characteristics of the system and practical legislative and judicial situation.
