Analysis Of The Localization Of The System Of Criminal Reconciliation

Now,it is not only a countrywide and strategical mission to establish a harmonious society,but also a perfect goal that everyone identify with and persue for.Considering this backgroung,a brand-new system of solving the criminal antinomies-the criminal reconciliation system is vividly-portrayed.It is not only accord with the require of establishing a harmnious society and processing a criminal justice innovation,but also assort with the criminal justice developing direction of humanistic and tolerance all over the world.The criminal reconcilation has developed very well in some hesperian countries,such as Germany,America,New-Zealand,but in china,there is no matierial system to regulate it,however, many local law departments have already explored it practically.This paper aims to discuss the necessarity and the feasibility of establishing the criminal reconcilation system in china,also it try to put forward the rational system design and make it combine with the actual criminal systems in china to contribute to the revolution of the criminal justice and the found of the harmonious society.This paper contains four sections.Section 1 defines the criminal reconcilation system by introducing its characters and comparing to the other similar concepts. Section 2 presents the necessarity of introducing the system into china after discussing the actulity of our criminal litigation and the advantages of the criminal reconcilation.Section 3 demonstrates the feasibility by describing the domestic environment consists of political,legal,cultural settings.The last section presents the detailed system design with a view to the situation of the country.
