The victim is a special party in China's criminal proceedings. There is an existing conflict between the legal status and litigation rights of victims. Nowadays, one of the important trends in criminal procedure is a pursuit of human rights protection, in which reflects the democratic, scientific and international course. The connotation of human rights protection is a broad concept. Therefore, in this context, we should pay much more attention to the litigation rights of the victims when we focus on the protection on the defendant rights. So this article will elaborate some related subjects about this field, with the angle of prosecution of criminal victims and the constraint and equilibrium of the criminal proceedings structure.This article includes 5 chapters:Chapter 1st mainly focuses on the definition of victim's litigation rights under the macro background of Victimology. At the same time, this article will also introduce the emerging and development of this doctrine.Chapter 2nd investigates the conceptual basis of victim litigation rights from three angles, which are human rights, litigation structure and procedural justice.Chapter 3rd investigates procedural rights and litigation status of victims, combining with various litigation systems in different historical periods.Chapter 4th uses the methods of comparative law and investigates some civil law and common law countries, and will draw the conclusion.Chapter 5th will concentrate on procedural rights of victims in China. These will be divided into two kinds of rights, participation rights and protection rights.
