Judicial independence is the foundation of western constitutional government, the fruit of western capitalist reform and the core concept of modern judicature. The rule of judicial independence was first introduced in China in late Qing Dynasty, symbolizing the kickoff of modern judicial independence in China, and lasted to Nanjing Nationalist Government period.This thesis, based on analysing the characteristics, obstacles and value of judicial independence at various stages in modern China, will probe into the historical path of judicial independence development in modern China, expecting it could be useful for the development of judicial independence of China.
