The voluntary arbitrary rule is an important evidence rule of criminal procedure, and this article will be divided into five parts to describe the rule.Part one is a summary. The author will make it clear what is voluntary arbitrary rule at first, then state the significance of creation of the rule according to judicial justice and procedure justice.Part two will deal with the basic concepts of the rule mentioned. Here the author will define the meaning of the rule and give deep analysis on factors influencing arbitration, for instance, violence, threat, seducing, cheating, etc.Part three will deal with the burden of proof related to the rule and the assingment of the burden of proof. In this part the author will introduce main practice of the continent law and the common law.Part four will deal with the establishment of the rule in our country. There is not the rule in practice or law nowadays in our country. The author will put forward some specific details of the rule and regulations.
