Compulsory Health System Research

As a tough problem faced by modern society, compulsory treatment of the mental patients attracts wide attention by countries all over the world. According to this thesis, compulsory treatment of the mentally ill is a kind of criminal law enforcement measure, based on the theory of social security doctrine. Since the mentally ills will lost their capacities of discernment and control, they need receive compulsory treatment. Meanwhile, during the compulsory treatment, it is very essential to protect the legal rights of the mental patients and prevent the misuse of power.This thesis is divided into five parts. Part one is the definition of compulsory treatment through the analysis of social security theory. This part also elaborates the function and feasibility of compulsory treatment of the mental patients. Part two is the introduction to the law system of compulsory treatment in America and Germany through the analysis of the different modes of compulsory treatment system. Part three is mainly about the present situation and problems of compulsory treatment exiting in our country. Part four is the advice for the built up of compulsory treatment law system in China. The last part is the conclusion of this thesis.From many aspects addressed in this thesis we can see:The real protection of the rights of mental patients, standardize the procedure of compulsory treatment is a very difficult project which faces modern civilization. I hope this thesis can play a role in better ideas, I sincerely wish the majority of scholars can pay more attentions to the protection of mental patients and try our best to solve improve their situations.
