Condemnation law is a hotspot in the field of legal theory in recent years. The purpose of the study is to make a theoretical research and analysis on the condemnation law and summarize the principles and thoughts of it in terms of the U.S. constitutional law. This dissertation can be divided into three chapters. The first chapter mainly focuses on the definition of condemnation and the meaning of eminent domain power. The concept and classification of condemnation is discussed in this chapter. it also includes the explanation of the contribution of condemnation law to the rule of law as well as the basic meaning of eminent domain power upon which the condemnation law is based. The second chapter mainly summarizes the theories of condemnation law and covers basic ideas of natural law, legal pragmatisim, and legal economics. The third chapter mainly introduces the three principles of condemnation law in which due process principle provides due procedure for condemnation and attachs importance to courts, fair compensation principle defines the standard of fair compensation and other ways of compensation, and the public use principle plays an critical role in histroy and lays the foundation of rational basis review. In the end of this dissertation, some basic rules of condemnation for commercial purpose are briefly discussed.
