Testimony Of Witnesses In Criminal Proceedings

The testimony of witnesses is one of the most common evidences in criminal proceedings, which is widely used in the judicial practice and plays an important role in criminal proceedings. But whether from the perspective of existing laws and regulations, or from the specific perspective of judicial practice, it can be said that some testimonies of witnesses have been ignored. China's legislation on witness testimony is too simple, which leads to the neglection to the witness testimony in judicial practice as a form of evidence, making an already important evidence that can prove the facts of the case always turn to externalism and fail to fully play its due roles. China is still in the stage of theoretic research and exploration for various thoughts and still has many unsatisfactory areas need to be resolved in practice.We found that the extra-territorial system of criminal proceedings in terms of witnesses has been very mature no matter in legal regulation area or in practice, worth learning. This article will clear up the existing problems in our current Witness system field, and put forward priliminary ideas to further improve the system of the Witness, by drawing on the advanced experience of extraterritorial and combining with China's national conditions. This article is divided into five parts as following:The first chapter:this chapter is about general theory on the testimony of witnesses in criminal proceedings, laying a good foundation for the next four chapters.The second chapter:this chapter mainly reviews the system of extraterritorial criminal investigation of witnesses so as to learn the advanced methods from extraterritorial system.The third chapter:this chapter mainly analyzes the existing problems in China's Witness system and find out the reasons of thses problems.The forth chapter:this chapter mainly elaborates and analyzes the current status of China's witness mode in criminal proceedings.The fifth chapter:this chapter mainly puts forward ideas for China's witness system in criminal proceeds by combining with the advanced extraterritorial methods.
