Financial Crime Criminal Law Perfect

With the continuous development of China's reform and opening-up, China made great achievement in economic development and the financial sector also grows rapidly. However, crime committed by financial practitioners occurs more frequently in recent years, of which there are some significant cases with considerable money involved that cause great loss to the nation and people. Financial crime impacts a lot the establishment and improvement of our financial, insurance, fiscal and tax system and increases enormously the financial risk. Furthermore, it also brings adverse effect on the further development of China's economy and some significant economic crimes even endanger social stability.As such, it is imperative and must to crack down on financial crime. In order to fight against various financial crimes more scientifically and effectively, it is necessary to analyze and probe into deeply the new phenomenon of financial crime, study the nature and manifestation of financial crime, figure out the issues can be controlled further. In this way, it cannot only crack down on financial crimes but also is of great importance to the order and sound development of our economic and financial market. In terms of legislation, there are certainly some oversights and controversy in our criminal legislation. Based on these oversights and controversy and considering the characteristics of financial crime recent years, this paper will analyze and discuss thoroughly financial crimes from the point of criminal law with criminology theory and research methodology, propose opinions on financial crime and hope that it will be useful for fighting against financial crime, maintain financial stability and the sound development of China's economy and finance.This paper consists of three parts. Part 1, introduction, mainly bring forward problems and explain the research background, research purpose and significance. Part 2, the main content, including three sections: expound on the general situation of financial crime; analyze the current situation, new trend and causes of financial crime; analyze the completeness of China's criminal law of finance, discuss about the existing problems with our criminal law of finance, such as inadequate internationalization, conservative setup of crime constitution, inaccurate definition of crime nature and improper classification of crimes; make proposal on improving the criminal law of finance, for example crime additional, crime extension, and crime transfer. Part 3, conclusion, the summary of this research as well the deficiency and further research direction. The last section is the bibliography.
