Defective Product Recall System

With the accelerated process of China's modernization,more and more varieties of social product. Commodity trading frequently in a wide scale. At the same time because of the design,production and marketing reasons for the formation of defective products,the damage caused to consumers is also increasing. In today's world defective product recall system,especially the developed countries have been universally established. Proved defective product recall system to improve product quality consciousness of producers legitimate rights and interests of consumer protection has an important role. But so far, mainly in China to stay relevant system level in the administrative regulations,the legal level is low,binding weak. China is still a lack of a recall system for defective products specifically for the overarching legislation. Recall defective products based on our own system of conditions,we should learn from the experience of developed countries and migration,combined with China's national conditions,establish a sound legal system, the recall of defective products to personal and property safety of consumers,to provide full protection.This paper aims to compare the United States and other developed countries in the product recall system,legislation,application and other aspects of experience and lessons for China to recall defective products,improving the legislation system aims to provide advice.Briefly described below under the main content of this article.This article is divided into four parts,the first part introduces recall system for defective products,the basic theory,including the defects,the recall of definitions, classification of product defects,and compared with other similar systems. And to clarify the basis of recall system for defective products, the meaning of existence and development.The second part introduces recall system for defective products,the theoretical basis and legal nature. This article tries to economics,sociology and law three defective product recall system demonstrate the theoretical basis and on the basis of economic law on the emphasis of the system properties and status.The third part introduces domestic and foreign recall system for defective products, research status,by analyzing the introduction of national significance with the typical cases and the status of implementation of legislation,the legislation described the reference to China,and in China an obstacle to the implementation of the system . The fourth part,on the basis of the third part of the recall system for defective products built in China should have the basic requirements and gives legislative proposals.
