Since the term of"medicine"born, it's characteristic of "two-edged sword"shows that it is the incarnation of Angel and the devil. Countless people's diseases, because of the pharmaceuticals, can be cured, and whose life expectancy is extended, while there are still millions of people under the toxic effects of medicines, whose life in the shadow and struggling. Meanwhile, the pharmaceuticals as a kind of commodity, manufacturers want to use it to chase the maximum benefit like other general products. This makes it more far away as the Angel.Since the beginning of the 20th century, chemical and biological medicines are popular and spread using. On the one hand, more and more diseases are cured by medicines, while, on the other An an increasing number of drug disasters happened. Even more frightening is that the latency of damage is very long,the drug ingredient is too complex and the pharmacologic reaction cannot easily clarify. Many of the victims could not receive due to compensation. And the medicine manufacturers'crazy chasing of business interest and ignorance of social responsibility make a more catastrophic incident which harms the harmony of society.The above facts let us recognise that only to put stricter regulation on medicine manufacturer and full compensation to drug misadventure victims, that the consumers can receive the maximum protection, and society can be orderly develop. The medicines are different from the general products, but our existing laws, which embody many loopholes and ambiguities, are not conducive to the injury compensation. So only to understand and investigate the characteristic of medicine, we can better to regulate it legally.In order to make a deeper understanding, this thesis will discuss the tort of medicine in three paths.
