Research On The Mechanism Of Small Tourism Dispute Settlement

With the rapid development of tourism industry, tourism disputes are also increasing, especially like small tourism disputes, so if the small tourism disputes can be properly handled, if tourists rights can be effectively protected has become the key to the development of the tourism industry in the future. But due to the limited choices of the current small tourism disputes solution, the low efficiency of dispute resolution, and the low degree of internal link mechanism cooperation, it’s hard to handle mall tourism disputes effectively and make the solution of the tourism complaints in embarrassment.Through the analysis of the literature and the review of previous research, on the basis of architecture research framework, from two aspects of theory and practice, the author defined small tourism disputes conception clearly and analyzed the composition of small tourism dispute resolution mechanism. Combined with field surveys and participated in small tourism dispute resolutions, the author analyzed small tourism dispute resolution mechanism in-depth, including the justness and efficiency and the economic problem. And through the questionnaire survey and data analysis, validate the four factors which restrict the function of the small tourism disputes settlement mechanism. Draw lessons from foreign consumer dispute resolutions experience, like the use of industry association efficiency in dispute resolution, the practical of arbitration, the innovation ways of dispute resolution and the heighten legal remedy humanization and economization, proposed the basic goals, value orientation and the perfect ways for our country’s small tourism disputes settlement mechanism.The focus of this article is the structure of small tourism disputes settlement mechanism system, which is supported by its internal system, operation system and evaluation system. These three internal system support each other and interact each other, finally promote small tourism disputes to be solved timely and effectively.Because of the existing drawbacks in justness, efficiency and economic, tourism dispute settlement mechanism should be promoted in enhancing the law consciousness and ability of tourists, abundant and effective the dispute resolutions,perfect the system of organizational support, deep the dispute resolving team skills,perfect the legal system, etc, in order to achieve the research purpose in this paper.
