In recent years, frequent exposure of child abuse cases, and "Wenling child abuse case" raises public to pay close attention to child abuse behavior. Since China is currently no law against child abuse behavior of family members outside the specific regulations, leading eventually to withdraw criminal cases the police, only the parties settled order punishment. Accordingly scholars on whether the criminal acts of child abuse, whether alone set up a "crime of child abuse" issues such heated debate. This article is also from several aspects as a starting point, the main focus of non-family members, child abuse behavior, especially kindergarten child abuse for analysis, the article is divided into four parts, the first part of Wenling child abuse cases were introduced, and related charges and disputed points were elaborated and division, highlighting our kindergarten child abuse laws regulating behavior is missing. The second part of the present situation of child abuse from the analysis, and the actual behavior of child abuse criminal regulation of the necessity and feasibility were discussed in detail, and ultimately come to child abuse behavior Criminal Regulation urgent conclusion. Third, the idea about the criminal acts of child abuse, refer to "CRC" establishes the principle of the best interests of the child, which is for the protection of children’s rights can be said to be a major legislative principles, to establish the principle that the future of our country can exhibit commitment to child protection, this section also describes the United States, Japan advanced experience in the protection of children. Finally, I sincerely made recommendations in three areas.
