The Current Capital System And The Protection Of Creditors

This paper mainly focused on the relationship between the corperation capital system and the creditor protection. During the 40-year reform and openning-up, China is in a transition from its planned economy to a socialist market economy, the old corperation capital system act an important role at that times. With the improvement of our socialism market economy, the new revised Company Law shows us the compromise capitalist system is changing to the subscribed capital system. Therefore, to improve the system of creditor protection becomes more important. As we know, the protection of creditors throughout the company operation, so I will prove the measures of how to protect the creditors better in a capital system way below.
