Research On Judicial Publicity In Microblogging Environment

Open justice, which is the cornerstone of modern nomocracy society, to reveal the judicial democracy, to achieve justice is of great significance. The implementation of the principle of open justice, it is necessary to rely on the traditional media, but also take advantage of new network media. In the new media age, microblog as a new platform that the courts at all levels to implement the principle of open justice which is unfolding. In recent years, the number of court opened microblog increasd sharply, so that it has become an important channel for the promotion of open justice. Court microblog plays an important role in improving the efficiency of the trial, facilitating the masses litigation, promoting fair and honest law enforcement, practising judicial activism, to resolve the crisis and other aspects of public opinion.This paper intends to promote judicial justice from the perspective of using micro-blog,elaborating those five areas that the concept of microblog, characteristics,development, and what features can effectively promote the degree of public justice, the case of Western countries using microblog in open judicial, the court microblog’s problems in the content of the operation and problem-solving strategies. Under the condition of the court has open micro-blog, how to change the status quo use to play its role in promoting public judicial respect is the goal of this writing. Under the premise of the author analyzing microblog on the use of open justice in the actual situation, applying theory to practice, using the method of comparative analysis, from the aspect of the microblog in promotion of justice public, discussed the value of the use of microblog,microblog potential function in opening court information, by drawing on the experience of foreign courts in this respect, concluded that micro-blog did not play its due role in the judiciary, the fundamental reason is that lack of understanding to the microblog environment Nature and Law. Further, for problems that using microblog to open judicial information in the laws and regulations,and system management, we should discuss how to improve it in legislative and court microblog internal management, the microblog live trial need to take what measures, to protect the microblog play a role in the public areas of justice.
