On The Protection Of Civil Law On The Interest Of Non - Born

Since Rome law,the discussion on the civil legislation of the unborn child protection has never been stopped in various countries.The corresponding civil legislation protects the unborn child has been made in various countries.But the legislation to this problem of our country is almost blank.So we should establish the civil legislation system of the unborn child protection.This thesis is based on the theory of civil law and combined with the legislative provisions and judicial practice of unborn child interests protection all over the world.The author makes a detailed analysis on the establishment and formation of the modern unborn child protection theory in our country after draws lessons about the unborn child protection from other countries.At the last part of this thesis,the author puts forward several detailed proposals of the unborn child protection.Specifically as follows:endowing the unborn child with quasi-personality,investigating the civil legislation mode of the unborn child protection,and putting forward specific legislation of the unborn child protection.
