A Case Study On The Regulation Of The Administrative Discretion Of Water Administrative Punishment

The right of discretion is the core of the administrative law. It is like a “double-edged sword”, if authority department properly use can protect the legitimate right of people and achieve the justice of the case, or it can damage the right of people and destroy the effect of the law, and cause bureaucracy and corruption. The discretion of water administrative penalty is the important component of the modern water administrative penalty law. It will strengthen the efficiency and the level of administrative law enforcement, and promote the practice of administration law. This paper will analyze the typical cases of the discretion of water administrative penalty law and propose some useful suggestions to perfect the regulations of administrative law.
