Research On The Counter - Guarantee Of Guaranteed Company

Currently, the legislation of guarantee system is still at the primary stage and it is imperfect. As the most active factor in counter guarantee system, guarantee company plays a very important role in the aspect of financing. Counter guarantee problem in guarantee company is, in the final analysis, the legal issues in which improvement of legal rules and the optimization of the structural system can fundamentally safeguard the realization of capital flows, so the financial system is a summary of rules on the basis of law system. This paper argues that only from the perspective of law under the guarantee company’s counter guarantee problems can we understand our counter guarantee system, this article embarks from the specific case in this paper, to illustrate how to maintain their own interests, and promote the deal in existing counter guarantee system. The analysis of the first part of case, raises the concrete counter guarantee system, as well as the related principle of the system, through the way of establishing of the guarantee and the counter guarantee system structure model. The second part, from the perspective of case study, to analysis concrete issues in the process of guarantee company taking counter guarantee measures under the system of property law and security law. The third part discusses the common problems of counter guarantee in China’s guarantee companies’ practice, and originally introduces and analyzes loan main body status in counter guarantee system. The fourth part is based on the actual problems in the process of operation, to put forward suggestions for perfecting our guarantee system and the future development trend of counter guarantee system for guarantee company.
