Research On Adult Guardianship System In China

The system of adult guardianship concerns about protecting wards dramatically due to "respecting rights of self-decision", "maintaining the normalization of independent living"in order to meet those vulnerable groups’needs,maintain fundamental interest and then promote all-round social progress.However, in terms of the existing legislation,the system of adult guardianship has many defects,such as old-fashioned legislative concept,unscientific legislative style,narrow custody objects,defective legislative contents,which neglects the importance of adult, guardianship and is not fit to today’s economic society.To make it clearly of the study object,the paper is on the overview of the system of adult guardianship. The first part summarizes the concept,nature of the adult guardianship,its origin and theoretical foundation.The second part is about the analysis of changes and current specific provisions on foreign countries’adult guardianship system.According to the contrast in different ways on mode,concept and style,the author finds the same points and different points.Eventually, in the light of Chinese legislative status and social realities,and in the view of the actual situations,the specific provisions of Chinese system of adult guardianship are presented to point out the short-comings of Chinese current system and put forward the proposal on the reform and the perfection of Chinese system of adult guardianship.
