Research On The Right Of Degrading Insurance Contract

Insurance system of contract rescission is a very important legal relief system when the insurance contract equilibrium is broken. It can regulate and restrict the contract relations effectively, the rights and obligations of the parties make both parties responsibilities and interests balance. Because of the insurance industry starts late in China, the system of our country "insurance law" in the insurance contract termination right legislation is not very perfect, academic core problems still exist in this system. The article from the nature of the insurance contract rescission system, classification, summarizes the legal basis of this paper summarizes the basic theory of insurance contract termination right system, discusses the current "insurance law" for different provisions of the applicant in detail and the insurer, focus on combing the legal consequences of exercising the right to terminate a contract of insurance problems, analysis of the legislative defects existing in the insurance contract termination right further, puts some suggestions to the system of insurance contract rescission further.
