Research On Civil Law Protection Of Personal Information

Along with the higher frequency of information using nowadays, personal information slowly becomes a more and more important social resource, and the property of the personal information value is gradually emerging. When the commercial value of personal information brings large interests for the society, the phenomenon of abusing and illegal collection of the personal information also comes at the same time, so the personal information protection is needed. Abroad has issued a special law to protect the personal information, among which Germany and Taiwan of China are good representatives. Nowadays, China doesn’t have any specialized laws for protecting personal information yet, thus when the information is abused, the effective relief path cannot be easily found. And it will also hinder the development of market economy in China and the international exchange and cooperation. The civil law is closely related to citizens’ lives, and its protection has the characteristics of convenient, efficient and comprehensive. Therefore, this article studies how to protect personal information better from the perspective of civil law. This paper starts from the introduction of the concept connotation and characteristics of personal information firstly; then introduces the legal system for protecting personal information of the main representatives of overseas, which are Germany and Taiwan, to gain enlightenment based on the analysis of oversea legal system of protection of the personal information. Secondly, this paper discusses on the relevant provisions of civil law of the personal information and the existing problems in China, and analyzes its reason. Finally based on the analysis of the above, it concludes the corresponding countermeasures: firstly, make clear the right regarding personal information of the regulation in the civil law; secondly, detail the rules related to personal information for the liability for damage compensation; thirdly, enact the special law to protect personal information.
