Research On Medical Dispute Handling Mechanism

With the deeper reform of health car e and the rapid developm ent of m edical science, the doctor-patient contradiction is increasingly prominent in our country. The medical dispute intensified, and even violence injury medical event becomes common occurrence. Violent injury medical event is also called "medical disturbance ". This phenomenon not only seriously interferes with the normal order of the hospital, what has affected the social harm ony and stability of life, for med the bad atmosphere in society, also run coun ter with the spirit of building a harm onious doctor-patient relationship by 18 th National Congress of CPC.In recent years, the medical violence occurred frequently, with the characteristics of wide range, variety and complex of reasons. The majority of the solution is mainly in compensation, and the am ount is huge. It causes a certain negative impact on the community and should not be underestim ated. Increasing medical disputes have not only hindered the healthy development of medical and health undertakings, also affect the harmonious stability of our country’s social life. Therefore, how to resolve medical disputes and how to af fect a radical cure "medical alarm" has become an important problem urgently needed to be solved in today’s social life. The reasons of medical dispute and ‘medical disturbance’ are complex. There are f actors such as laws and regulations and social public opinion. This paper ar gues that early warning mechanism should be established in orde r to elim inate the hidden trouble of the medical disputes. We need to im prove the medical dispute prevention mechanism, effectively reduce medical disputes to prevent the occurrence of medical dispute from the source. Medical disput e prevention and treatm ent mechanism is not sound in China. The m edical institutions internal process heavily an d complicatedly, this is leading to its applicatio n in accordance with, the root cause of the high incidence of medical disputes. We should first start from the system construction, establishing and perfecting the laws and regulations to avoi d medical disputes occurred. Secondly, we should eliminate loopholes and op timize the internal structur e of medical institution. Finally, we should set up reasonable process and reduce the m edical disputes caused by patients who are rep eated treatment and delay the disease to set suitable medical dispute processing mechanism.First, this paper em barks from the resear ch status quo of medical dispute, summarizes the content, principle and the present situation of the current m edical dispute processing m echanism. Second, we analyze and compare the dom estic and foreign medical dispute processing mechanism to find out the problems existing in the current medical dispute resolution mechanism in China. Then we research the fundamental cause of m edical disputes, su ch as the lack of related laws and regulations defects in m edical disputes, the society and the governm ent’s inappropriate behavior and unreasonable internal structure and so on. According to the above, we suggest that it should strength en the legal consciousness of m edical personnel training, improve the medical dispute system construction, optimize internal structure of medical institutions etc.
