A Study On The Legal Status Of Regional Administrative Agreements

Now, more and more countries pay attention to regional integration, and it is really a good way to improve their national power. Administrative agreement has great effect on break the regional administrative barriers, provide public products and give full play to the market. As a new way of inter-government cooperation, administrative agreement has been widely used in dealing with inter-regional administrative affairs. In our country, administrative agreement has been widely used in Yangtze River Delta, Pearl River Delta, Bohai Sea Region and other places. There exists many administrative agreements in environmental protection, energy development, trade promotion, agricultural cooperation, infrastructure projects, tax collection and administration, food supervision and so on. Administrative agreement has appears in political science, economics and management science, but in our country, but few scholars in administrative law field research on it. As a result, the theory can not guide the practice. It is necessary to research on administrative agreement, so we can enrich our theory and use it to guide the practice.In this paper, I will use the methods of literature research and comparative research, and analyze our administrative agreement in Yangtze River Delta, Pearl River Delta, Bohai Sea Region and other places. There are four chapters in the paper.In the fist chapter, I will overview administrative agreement. I will introduce its concept, characteristics, classification and contents. And I will analyze its reasonable existence, and the the current development in our country and abroad. In the second chapter, I will analyze the nature of administrative agreement from two aspects, that is it is a kind of governmental act and an administrative contract between equal administrative entities.In the third chapter, I will analyze the legal effect of administrative agreement. I will introduce the practical effect of administrative agreement in our country and abroad. And then I will analyze its actual effect and effective grade.In the fourth chapter, I will analyze administrative agreement in our country has four problems, that is lack of legal basis, disorders of administrative entities in entering into an administrative agreement, lack of due process, and incompleteness of its content. And I will introduce how to settle them.
