A Study On The Maternity Protection Of Migrant Workers

Although reproductive behavior should be borne by women, childbearing is social labor which create labor reproduction. when people accept the social value of birth, people pay more attention to the costs and risks of women’childbearing. Therefore, more than 150 countries and area in the world has established the social security system and most of them contain the content of maternity insurance. Maternity treatment is better than other insurance’. Labor Insurance Regulations, promulgated in 1951, contain the maternity insurance that indicates that maternity insurance had formally established in china. However, maternity insurance is still considered as an unimportant insurance and develops slowly. Pan Jingtang believes that the number of beneficiaries of maternity insurance should be the maximum of the five insurance program because maternity insurance is related to the health of mother and infancy and everyone grows from infancy. In fact, people who covered by maternity insurance and the number of fund expenditures are minimal. We doesn’t put great emphasize on maternity insurance which doesn’t cover migrant female workers clearly. Enterprises don’t pursue the maternity insurance on their own initiative when lack of effective regulatory system. Many migrant female workers do not even know their own rights and interests of the maternity insurance. Because that many migrant female workers can not enjoy the protection of maternity insurance system and lack of appropriate rural maternity protection facilities when they return to countryside to give birth, they encounter various birth risks.Based on the literature analysis and empirical investigation of the migrant woman workers who return to the countryside to give birth in W country of AnHui province, the paper found out that rural women are facing birth risks:economic risk, health risk and employment risk. Finally, analyzing about the reasons of birth risks, the paper propose to extend the coverage of maternity insurance system and improve the rural maternity protection complementary measures to defuse the birth risks which migrant female workers encounter.
