Is not what the legal concept of "small property right", but the people in the social life practice to form a more prescriptive. Small property right amount increase gradually in recent years, the price is rising year by year, huge profit space lead to more small property right was born, but the characteristic of the land system in China led to the embarrassment of small property right status.The emergence of small property right in our country has its special system, economic background, caused by the following social contradictions and the subsequent problems, and to the stability and development of the society, our government has to think of some way to solve as soon as possible. But, how beautiful the processing of small property right, and most focus on the core of all society. Because of its legal grey areas, generational, so treatment must also be wary of it.In this paper, the full text has the following five parts:The first part is introduction, mainly describes the understanding of the "small property right" this noun, the historical origin of the small property right, and its concept and basic characteristics.The second part discusses the small property right since there has brought some social contradictions and conflicts of interest. In between the government and the rural collective land circulation process of conflicts of interest, the distribution of interests conflict in the process of land development. Through these interests, smallproperty right problem needed to solve, to be strong not to stay.The third part mainly elaborated the current social situation on the research of the small property right value, as well as the present research status of small property right problem.The fourth part and the fifth part is the main part of the paper. In this paper, the author view is recommended for the small property right legalization, so in the fourth part focuses on small property right analysis of the legal reason. The fourth part is divided into two big modules, respectively from the aspect of legal and social reality level analysis of the necessity for the legalization of small property right.And the fifth part is the author for the legalization of small property right some personal opinions and Suggestions. Legalization of small property right to put forward the feasibility of the path, and puts forward the relative risk is likely to accompany. The end summarizes the legalization of small property right way tips safeguard mechanism. Looking forward to the small property right problem can be fair and reasonable solution.
