Minor crime punishment system is an important part of the field of criminal penalties. With the rapid development of our society, the number of minor offenses showing a linear increase in the state, but our system of penalties for minor offenses cannot be adapted to this change. Therefore it is necessary to improve the system for minor offenses, which played an important role in the protection of human rights in China. With reeducation through labor system was abolished, to be punished by reeducation through labor into a blank. Build a new system to fill the gaps become imperative. However, the layering of the system can not conducive to the actual operation. Therefore, it is necessary to improve the existing system of minor offenses, object of reeducation through labor. In this way, the system can reduce the obstruction, but also facilitate the practical role. I refer to the West the police prosecution system, plea bargaining system, which played an important role in the construction of the new system. Improvement of the current community correction system, it helps to deal with minor crimes handling mechanism is not included in the object of reeducation through labor. This article from the current definition of minor offenses and reeducation through labor object, analyzes the current situation in our country both in the actual operation, trying to find the possibility to achieve a unified treatment of both; through plea bargaining system and the police prosecution system presentation and analysis to find a foreign country to introduce the possibility of a mature system with reality in order to build up a new system of handling minor offenses.
