A Study On The Circulation Of The Right To Use Homestead In Huaxi District Of Guiyang City

One piece of rural homestead involve variety and multiplicity rights, including rural collective land ownership,homestead right of ownership and use,proprietary right of farmer house,right of habitation,and so on.Because different rights relate to the different main body, so the countryside homestead right of use circulation will involve the rational allocation of transfer interests between different subjects. Our country is in the historical stage of breaking the two structure in urban and rural areas,speed up the realization of urbanization, interests are more complex and diverse,exacerbate the difficulties of constructing circulation system of homestead right of use. Through analysis of the survey materials, author find out the most prominent problems of the the homestead right of use in circulation of Huaxi area and propose appropriate solutions and suggestions, in order to establish perfect homestead right of use circulation system of Huaxi District,to provide institutional guarantee of improving the rural land utilization rate and increasing the farmer’s property income.This paper is divided into four parts.In this paper, the first part is the introduction, mainly expound the background and significance of research, research status, comprehension to the concept of the homestead right of use.The research of this paper in the background of breaking two structure in urban and rural areas and deepening the rural land system reform of our country,accords with the present situation of economic and social development,conducive to improving utilization rate of rural homestead land and increasing farmer’s property income in Huaxi district.Researching the current theoretics and combing laws and policies deepen the author cognition of homestead system, which contribute to accomplishment of the paper.Only by fully understanding the process of historical change of homestead system, we will have a better understand on connotation and characteristics of homestead right of use,which is the premise to finish the paper.The second part of this paper briefly discusses the basic situation of the investigation,through the access to the Huaxi District Court file, questionnairesurvey on the some villages in Huaxi district and interviews to grass-roots staff of Huaxi District,author master rich material of circulation of rural homestead right of use in Huaxi district,that Is the basis for the completion of this paper.The third part is key point of this article, problems and suggestions of the use right of homestead in acquisition,transfer, withdrawal, dispute resolution are expounded,including support for paid use,through the construction of rural apartment to ameliorate the current situation of insufficient homestead,adhere to prudent,gradual, moderate homestead circulation,strengthen the land management,Improve land dispute solutions,and so on.In this paper, the fourth part is the conclusion, summarizes the circulation of rural homestead right of use in Huaxi district.
