Credit, is the inevitable result of the development of commodity economy, the modern market economy is credit economy in a certain extent. The credit that base on the rule of law is the life of modern finance, having a good social credit environment can guarantee the healthy and orderly development of market economy.The individual credit is the evaluation of personal capacity of performing contract and meeting obligations that obtained in economic society, is an important part of the whole social credit. Individual credit investigation is the activity which so as to play the role of ensuring the safety of the transaction, standardizing the order in the market, stimulating domestic demand and protecting financial risks through collecting personal credit information, professional arrangement and processing, and then making the personal credit reports open to the public.Although the system of individual credit investigation can have economic benefits and social functions, its object is personal credit information and it will involve the security issues of personal information privacy,so it has the natural contradictions with the protection of the right of financial privacy which has the pursuit value of individual freedom.With the gradual establishment of the individual credit investigation system,these contradictions will gradually come out in the series of individual credit investigation activities.How to establish a social credit system that can guarantee the justice, open and fair competition of the market, and at the same time protect the right of financial privacy of the information agent away from the violation, is an important task and a theoretical problem of improving the rule of market economy.This article is for the purpose of through elaborating the concept, evolution and development of the credit information disclosure and the protection of the right of financial privacy,analysing the necessity for the establishment of social credit system,tying to do a profound analysis of the contradictions between the individual credit investigation and the protection of the right of financial privacy from the jurisprudence level.And at the same time,disclosing the shortcomings of the positive law and putting forward some suggestions on its revising and improving,and finally putting forward my own ideas on the balance mechanism of the protection of the right of financial privacy under the individual credit investigation system in our country.
