Along with the rapid development of China’s economy, the science and technology level, population flow speed, the residents dwelling environment rigorously changed, the contradiction of dwelling environment is becoming more and more prominent, and therefore more conflicts between the dwelling owners and the contradiction between the community and developers are getting increasingly significant. Although membership right in condominium is already inclusive in China’s property law, the content is not perfect and meticulous yet, and many contents still need further research. Comparing with the exclusive rights, the common ownership is not said often enough as a vital part of membership right in condominium, and a lot of property management disputes occur in judicial practice, such as the disputes of ownership and infringement. The issue of membership right in condominium is getting more and more people’s attention. The meaning of the studying of membership right in condominium is getting more and more obvious.This article is trying to study whether the object of membership right in condominium is the in-common part., plus how to identified the rights and obligations of in-common part and how to exercise them via comparison and analysis methods by two civil law cases, in order to Analysis and grasp of the legal characteristics of ownership, focus on how to protect the membership right in condominium via the common problems of membership right in condominium.
