A Study On The Difficulties In Civil Execution

The civil procedure is an important system in our country’s legal system. It is the last stage of the activity of the civil procedure. It means the obligation of the court to enforce the law. But at present, there is not a civil compulsory execution code in China, and the relevant laws and regulations of civil execution are mainly "Civil Procedure Law" and some judicial interpretations of the Supreme Court. In the judicial practice, the problem is more prominent, the protection of the rights of the parties is not in place, but also damage the dignity of the law, damage the prestige of the court, and even affect the social harmony and stability. In order to solve the difficult problem, whether it is a theoretical research scholars, or judicial practitioners, have given a great deal of attention, and hope that as soon as possible to solve the difficult problem, in order to maintain the judicial order. With the rapid development of the market economy, the number of court accepted civil cases is also increasing rapidly, followed by a large number of cases of the implementation of the increase, the implementation of difficult issues will also be inevitable. This paper analyzes several problems of the implementation of the current difficult to implement, and through the specific case, to carry out the causes of difficult to carry out analysis, discussion, put forward the relevant suggestions, in order to effectively solve this problem.This paper is divided into three parts.
