The rapid development of economy and society also has brought a great impact to our natural environment, for example, the raging haze days, the damaged drinking water and the frequent extreme weather.At the same time, awareness of our citizens gradually increase the rule of law and want to choose to use legal weapons to safeguard their legitimate rights and interests. But the environmental factors pollution cases was hidden, cross-regional, and the main uncertainty. So the environment public interest litigation cases gradually appear in people’s vision. The development of the legal system has hysteresis characteristics, and is not synchronized with the reality of social development. In the case, the Prosecution can not to be the main proceeding to support social organizations and how to support become the key issues for the domestic and international environment law academic research.The latest release of the Civil Procedure Law,the Supreme People’s Court On The Trial Of Civil Public Interest Litigation Environment Applicable To A Number Of Issues Of Interpretation and the new Environment Protection Law provide some basic guidelines to the prosecution,as we all know, the current law is still in the development stage, there are many deficiencies needed to be improved.Firstly, we should explore the Prosecution supporting the civil public interest litigation in the jurisprudence, finding the basis of this system. Secondly, according to the actual situation of China’s development, analyze the difficulties of the Prosecution in the support of environment civil public interest litigation.
