A Study On The Crime Of Kidnapping

Looking the history of our criminal law,in 1979,our country’s criminal law didn’t set the crime of kidnapping, but with he crime of kidnapping’s harm is becoming more and more big to people’s physical and mental safety, it also become a big threat to the social’s peace.Our country’s legislature set the crime of kidnapping when they revised the criminal law in 1997.Because the crime of kidnapping usually cause serious damage, our legislature set the corresponding punishment measures.Because our criminal law’s regulation is general,what’s more the form of the crime of kidnapping is very different,so many cases can’t be convicted and sentenced in the name of kidnapping.Besides,there are many other questions in the stop shape of the crime of kidnapping,common crime and crime number form.This paper has five parts.At first,I introduce the crime of kidnapping in general,including the concept of the crime of kidnapping,the consist of crime of kidnapping and the legislative status of the crime of kidnapping,then I discuss three problems, including the stop shape of the crime of kidnapping,common crime and crime number form.In the final part of the paper, the writer discuss the crime of kidnapping in the real life,including the legislative status of the crime of kidnapping,find the deficiency and put forward solutions,and I hope that my study will help the construction of the law of the crime of kidnapping.
