For a long time, the mixed functions of the government and enterprises affects the forward pace of state-owned enterprises reform in nature, always become the fetters of state-owned enterprise in a market economy. The root of the mixed functions of the government and enterprises is the imperfect state-owned assets supervision and administration system, the third plenary session of the eighteenth make the mixed ownership reform of state-owned enterprises, state-owned enterprises existing property rights system will into the reform of the mixed ownership enterprises. So the problem of the mixed functions of the government and enterprises is still difficulties of the reform, to further promote the implementation of "separation of government and enterprises", the main goal of the reform is that state-owned enterprise system can be more robust. State-owned enterprises in the process of mixed ownership reform should advance angles, a redesign of the state-owned assets supervision and management system into the category of reform. Perfect system and the legal basis is the guarantee of the reform, this article through to the mixed ownership enterprise comprehensive analysis and research on the theory of government intervention, as a case study of X co., LTD.,deeply analyzes the current problems existing in the state-owned enterprises, find out the defects in the institutional design and legal aspects of state-owned enterprises. In this article, through comprehensive analysis and study of the mixed ownership of state-owned enterprises reform, the problem of "separation of government and enterprises" system and legal analysis, and the preliminary conclusions.
