Research On The Crime Of Smuggling Ordinary Goods And Goods In Cross - Border Shopping

With the rapid development of the mobile terminal technology, increasing commodities have been being sold through self media platform. As the top in self media, Wechat has given rise to a new kind of business——Wechat merchant crossborder purchasing. Wechat merchants find fertile ground to grow their own in the semi-legal area. Not only does cross-border Purchasing offer many employment opportunities, but also supplies domestic consumers with lots of high quality goods. However there is no denying that many Wechat merchants bring themselves into collision with the law when they conduct cross-border purchasing activities, composing of the crime of smuggling common goods and articles, violating the national foreign trade management system and the system of tax in accordance with the law.This article tries to study the cross-border purchasing phenomenon from the perspective of criminology and criminal jurisprudence respectively, and interprets the criminological characteristics of the cross-border purchasing behavior, and analyses the conviction and sentencing of the crime of smuggling common goods and articles. Wechat merchants are the behavioral agent in cross-border purchasing whose crime have the following characteristics——with the action networked; with the objects based on daily life; with the amount of money descending; with smuggling frequency raising; with the damage of smuggling discreet. Therefore, Wechat merchants present traditional crime of smuggling common goods and articles a new problem. How to judge and deal with the crime of smuggling common goods and articles in judicial practice when Wechat merchants offend this crime, will be discussed in this paper.In brief, this article attempts to make a systematic analysis of the judicial deduction of the crime of smuggling common goods and articles based on the analyze of the characteristics after Wechat merchants offend this crime in the process of crossborder purchasing.
