Allowing citizens to participate in deliberation and administration of state affairs well reflects their status of being the masters of the country, embodies the expansion of freedom of political expression and providesan important means to social democratic development. In the wake of the era of web 2.0, the Internet grows up to beanimportant way for the party and the government to disseminate political information, publicizes the party’s principles and policies, enhance the citizen’s political awareness and achieve socialization of politics. “The combination of network and politics contributes to a new way of political participation, that is, online political participation, which not only changes our way of involvement in state affairs, but more importantly, brings forth new subjects on the legalization of online governing.For the first time in history, 4th plenary session of 18 th CPC Central Committee takes “rule the country in line with the law” as its theme, suggesting that the Party Central Committee attaches great importance tojudicial system reform. Under this ideology, government behaviors must be restricted by the law. Our citizen’s political participation becomes an important facet of consultative democracy. Online governing, among other things, has become a new way to get our citizens fully involved in our political affairs.Online governing must be legally administrated in an effort to realize its standardization, institutionalization and legalization and ensure that it would go on the track of sound progress.However, online governing is currently encountering many problems: inadequate laws and regulations; lack of supervision and control, lack of effective guidance for irrational online governing, to name a few. To solve these problems, this paper puts forth some proposals, including accelerating legalized process for online governing, strengthening legalized administration of online governing network, raising the citizen’s awareness of law and protecting the fundamental civil rights in accordance with the law. The article is divided into five chapters.Many recent cases are collected and analyzed in an effort to discuss these problems and to make this paper more persuasive.
