Shenjia This Late Qing Dynasty Repair Law

The modification of the law presided by Shen Jiaben on late Qing is the outset of the Chinese legal system and the milestone from Chinese ancient legal system to modem legal system. According to the backgrounds and the courses of the modification of the law on late Qing, the great changes of Chinese society which finally lead to the happening of the modification of the law on late Qing is analyzed deeply after the Opium War in this dissertation. Shen Jiaben, a famous legist of modem Chinese, made a deep conclusion and criticism on Chinese legal system of feudalism, and made a fully review and a selective absorption from the ideas and principles of the western capitalism law. Then he combined the two aspects together and applied them to the activities of modification of the legal system. He made initial and fruity efforts to the modem Chinese law. His ideas created during the modification of the legal system such as managing state affairs according to the law, justifying independently, sentencing crime according to the law, being equality in front of the law for everyone and so on, have the accumulating influence and signified useful for reference now. The modification of the law on late Qing indicates the breaking out of the old Chinese legal system and the foundation of modem legal system in China.
