One-sided Accomplice

The dissertation is a research on the theory of Unilateral accomplice in Criminal Law. The dissertation (approximately thirty-five thousand words) Consists of six parts except introduction. Whether Unilateral accomplice can be established or not, in addition to its establishing scope, has always been the question at issue in criminal theory in China and foreign countries. After studying such question by a comparative method systematically and deeply, this dissertation concludes that unilateral sclicitant and unilateral accessory can be established, and then, on the basis of such conclusion, significantly elaborates the questions related to unilateral accessory. When expounding the nature of Unilateral accessory, the author comments on the theory of independence on complicity and that of subordination on complicity in detail, and reaches a conclusion that the quality of unilateral accessory is the organic integration of subordination and independence, and analyses the constitution feature of the subjective aspect and objective aspect of unilateral accessory. The author probes into the intersection of unilateral accessory and the other criminal forms when determining the fact.
