ABSTRACT The paper makes a research into the related theory of the damage compensation of automobile communication accidents through the comparative law method, Its purpose is to protect the legal rights and interest of the victims. The train of thought of the paper is to do away with the guiding ideology of solving civil compensation by administrative means, and to put an end to the confused situation in civil compensation realm in which responsibility is judged in the name of pecans and civil affairs and administrative affairs are mixed, and thus to establish China抯 system of compensation for damage in traffic accidents. The paper can be divided into seven parts. Part one is on the general theory of damage compensation of automobile communication accidents. Part two introduces the legislation present situation and its perfection as well as its type and development. Part three is about the requirements and counterplea causes. Part four expounds the judgment criterion of the responsibility subject and its concrete practice. Part five discusses the victims and their right of claim from the property damage, the personal damage, the mental damage and the concurrent of responsibility angles. Part six focuses the subject on the contributory negligence application of damage compensation. In the last part, the author summarizes the core content of damage compensation system of the automobile communication accidents.
