Asset Securitization In China's Legal System

With the development of the reform of China, fmancing problem will become the key issue to protect our economy. Tili now, the development of the Chinese fmancing institutions is lagging behind the development of economv. We are still using the traditional financing instruments, which cannot satisfy the investment needs of the public.Securitization is the financing instrument created in the late 20' centurv. After 50 years development, it has become one of the most important investment instruments. In order to fulfill the structure financing, the securitization has created the special structure, which helps the enterprises a lot. To study and analysis such financing investments will help us in our future development, both in theoretical and practical.In this essay, I try to analyze and review the basic concept and the whole development progress of the securitization. I focus my analvsis from the legal prospect, and study the legal essence, effect and developing principles. The main part of this essay focus on the possibility to fulfill the securitization in China based in the legal and social environment. In the end of this essay, I also suggest some operation and management systems that may help the fulfillment of the securitization.
