Study On Environmental Crime

Enviromental crime is a basic problem in the theory of enviromental law and also an important constituent of the criminal law. Theoretically,as the new issue in the field of enviromental law,different people have different views on the basic theory of enviromental crime and the unified understanding has not come into being. For this reason,in the thesis,from the theory of the criminal law and the international,historical and practical point of view,I have made a comprehensive and systematic study of the basic theory of enviromental crime and the condition of the relevant legislation and presented some of my crude opinions with the aim of inducing others to come forward with valuable ones and lead to further research in the theory of enviromental crime and promote the development of making the enviromental and criminal law in our country.The thesis is divided into four parts:Part I:From the theory of the criminal law,I have given a definition of the enviromental crime and expounded the requisites to constitute a crime in the enviroment and pointed out the difference and connection between the enviromental crime and the relevant crimePart II:From the international point of view,I have made an overall investigation and analysis of the trend of making law,the form and characteristics of legislation in theenvironmental crime in the foreign countries.Part III:From the historical and practical point of view,I have discussed the change of punishing the enviromental crime and stated the condition of making the law of the eniromental crime and brought to light the defect in the present legislation of the eniromental crimePart IV:I have put forward the limitations of the enviromental and criminal and indicated the controlled limitations of the enviromental and criminal law determines the legislation and stipulated the reasonable controlled category of the enviromental and criminal law in our country and then offered the five suggestions of perfecting the legislation of the enviromental and criminal law in our country...
