Under The Trips Vision Problems Of Copyright Protection

The copyright protection mainly refers to the law-enforcing protection of copyright, including the administrative approach and judicial approach. Since China has joint WTO, Chinese copyright protection should be involved into WTO system. Comparing Chinese copyright protection of legislation, judiciary and administration with the regulation of WTO especially the regulation of TRIPs. it's easy to see that Chinese copyright protection system has reached the international standard, Chinese copyright protection level has already met even gone beyond the lowest protection criterion of TRIPs. Because of this, the author opposed the super-criterion protection and advocate the strict fulfillment of the legislation.In Chapter 1, the author reviewed the history of the copyright protection system in China and some foreign countries, revealed the trend that Chinese copyright protection system has gradually involved into the international copyright protection system. And made a necessary analysis of Chinese copyright law with the combination of the regulation of copyright and other related rights in TRIPS. The general conclusion is Chinese copyright protection has completely met the requirement of TRIPs on the legislative protection lager.In Charter 2. the author disussed the present condition of copyright in China, exposed the problems especially the super-criterion protection problem existed in judicial practice. In order to do the job of judicial protection of copyright after China joined WTO, the author put forward that we must attach importance to the regulations of copyright and ather related rights in TRIPs, meanwhile we mustn't disregard the present condition of science and culture development in China and the fact that China is disadvantageous country in copyright.In Chapter 3, the author discussed Chinese copyright administrative agencies and their functions, administrative procedures and measures, the custom's protection of intellectual property (with the emphasis of copyright). Finally the author gave some suggestions on how to cope with the copyright protection situation after Chinese entry into WTO and how to improve the judicial review system of the copyright protection administration.
