Asset Securitization Legal System Research

This paper mainly focuses on the study of law system on asset securitizition .The first part mainly gives out the definition of asset securitization, including its conception, categories, features, applying program and functions on economy and law .The second part is mainly devoted to the law principles of asset securitization, which has made an expanded exploration for the next part .The third part is the importance of the paper, discussing the law system of asset securitization. On the basis of analysis of reciprocity between asset securitization and law system, referring to the experience of asset securitization in developed countries such as America, it makes a systemic discussion on the pith of asset securitization-special purpose vehicle, bankruptcy-remote theory, the law effectiveness of asset-transferring, law system of credit-enhancement and credit-evaluation and law contents of securitization products. The fourth part analyses law environment of asset securitization in China on the basis of the former parts. Firstly it analyses the practical requirements of applying asset securitization in China, and then conducts a study on the law environment in China for applying asset securitization, and more puts forward corresponding measures. And it further provides that China should establish law system adjusting asset securitization. Finally there is a short tag as the end of this paper.
