Republic Of Judicial Examination System Research

The Institution of the General Judicial Qualification Examination (IGJQE) is of great significance to our Chinese jurisdiction. This article aims to provide some helpfulness for the development of the IGJQE through a historical review of the Institution of Judicial Qualification Examination(IJQE)in the Republican China (1912-1949).The first part defines the content of the IJQE which is different from the Legal Exam before 1905 or the Bar Exam in the Republican China(1912-1949).The purpose of the IJQE is to select the qualified judges and prosecutors ;The second part discusses the political,economic,social and educational environments under which the IJQE had been developing for more than thirty years;The third part describes the structure of this institution.We should consider the following points:the Exam's purpose,the Exam's procedure,the Exam's content ,the qualification for the Exam,the pass rate of the Exam and the judicial training .etc;The fourth part tells about the weakness of the IJQE:the privilege of being excused from the Exam and the defect traditional legal consciousness in the rural area;The next part provides a sociological observation of the Judicial Qualification Exam in 1932which can help us know more about the implement of this institution .The IJQE is not an extinct volcano,and now it still develops in Tai Wan district .In order to establish a perfect IGJQE, we should make more efforts to study the IGQE in the Republican China(1912-1949).i's...
