The theses and monographs on qualification penalty in China are very limited ,m other words,the study on qualification penalty hasnt formed a scale.This thesis aims at arranging its ordinary theories and legislative sources,selecting the essence, eliminating the dregs and coutributing to Chinese qualification penalty theories and legislative completion. It includes three parts.The first part elaborates qualification penaltys ordinary theories,includes its conception,history,status,time limit,suitable objects and ways,etc.The second part introduces the foreign qualification penaltys present situation mianly.This thesis chooses the important contents to enumerate and explain only,for the sorts and content stipulations of qualification penalty are so different that its impossible and unnecessary to introduce them wholly. With regard to^ foreign qualification penalty executive systems,the author discusses its reprieve and compound rights systems mianly.The third part discusses Chinese qualification penalty legslative insufficiencies and gives the opinions to complete it. The major insufficiencies are the political flavours thickness of depriving political rights, the lack of entities qualification punishment, etc. Therefore, the thesis puts forward legislative proposals of revising to deprive political rights and adding qualification penalty suitable for entities, etc.In brief,part one is a theory section,it lays particular emphasis on the study of the qualification penaltys objective law and it has guiding significance to complete Chinese qualification penalty legislation. Part two and part three are legislative sections, they lay particular emphasis on the study of the current internal and external qualification penaltys legslative conditions to achieve the goal of knowing not only ourselves but also them, studying skills from the foreign and surpass them.
